By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.

The website provides general information about coaching, training, speaking, sales leadership, assessments, business development, and related services. It allows visitors to submit inquiries, follow links to third-party resources, and schedule exploratory conversations. Nothing on the website creates a client, coaching, advisory, fiduciary, employment, partnership, agency, or other professional relationship. A formal engagement exists only through a separate written agreement accepted by the applicable parties.

3. Eligibility and Accurate Information

You must use the website only for lawful purposes and provide accurate information when submitting a form or scheduling a conversation. You may not impersonate another person or provide information you are not authorized to provide.

4. Acceptable Use

You agree not to:

  • Use the website in violation of law or another person’s rights.
  • Attempt unauthorized access to the website, systems, accounts, or data.
  • Introduce malicious code, interfere with operation, or evade security controls.
  • Scrape, copy, harvest, or collect content or information through automated means without written permission.
  • Misuse forms, booking links, assessments, communication systems, or unsubscribe functions.

5. Intellectual Property

We grant you a limited, revocable, non-exclusive, non-transferable right to access and view the website for personal or internal informational purposes. You may not reproduce, modify, distribute, publish, sell, license, create derivative works from, teach from, or commercially exploit our content, frameworks, workshop materials, or methodologies without prior written permission.

Names, logos, program names, framework names, and other brand identifiers remain the property of their respective owners. No license is granted except as expressly stated.

6. Third-Party Services and Links

The website may link to or use third-party services, including Calendly, HubSpot, Southwestern Consulting assessments and resources, and other booking, communication, or educational tools. Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for their availability, content, security, accuracy, or practices.

7. Complimentary Calls, Rescheduling, and No-Shows

The following expectations apply to complimentary exploratory conversations booked through the website:

  • Please provide at least 24 hours’ notice to cancel or reschedule.
  • A meeting will ordinarily end at its originally scheduled time, even if you arrive late.
  • If you have not joined within 10 minutes after the scheduled start time, April may leave the meeting and treat it as a no-show.
  • If you miss a meeting without notice, you may be permitted to rebook once at our discretion.
  • We may decline repeated, duplicative, or additional complimentary bookings, including after repeated no-shows or late cancellations.
  • Reasonable exceptions may be made for emergencies or circumstances beyond your control.

Paid engagements, client meetings, workshops, and other services may be governed by separate agreements or scheduling policies. If a separate written agreement conflicts with this section, the separate agreement controls.

8. No Purchase or Engagement Through the Website

The website does not currently sell services or collect payments directly. Information about potential services is preliminary and does not constitute an offer, acceptance, guarantee of availability, or binding engagement.

9. Disclaimers

The website and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant that the website will be uninterrupted, error-free, secure, complete, or suitable for every purpose. Your use of the website and reliance on its content are at your own risk. Our separate Disclaimer is incorporated into these Terms by reference.

10. Limitation of Liability

To the fullest extent permitted by applicable law, April Williams, “I’m Really Not a Salesperson,” and their personnel, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, or opportunity; or damages arising from use of or inability to use the website, reliance on website content, or third-party services.

To the fullest extent permitted by applicable law, any aggregate liability arising solely from the website or these Terms will be limited to the greater of the amount you paid specifically for use of the website during the 12 months preceding the event giving rise to the claim or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain exclusions or limitations, so some of the foregoing may not apply to you.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless April Williams, “I’m Really Not a Salesperson,” and their personnel, contractors, and affiliates from claims, liabilities, damages, and reasonable expenses arising from your unlawful misuse of the website, violation of these Terms, or infringement of another person’s rights.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law principles. To the extent permitted by law, any dispute relating to the website or these Terms will be brought in the state or federal courts located in Rhode Island, and the parties consent to their jurisdiction and venue.

13. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on the website with a revised effective date. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.

14. Severability and Waiver

If any provision is held unenforceable, the remaining provisions will continue in effect to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.
